Comparing the two may be a joke, but when it comes to law, the differentiation may be very important. Some would say that there is no difference between poker and state lottery. The dictionary says that gambling is to play games of chance for money or some other stake. The state lottery is no doubt a game of chance, but is poker really all about luck?
Asking people who have won large sums of money in poker, the answer is obvious. They do not believe that poker is a game of luck, but mainly skill. Of course, for winners of the World Series of Poker, there is a difference between marking down a number, and playing a battle of wits. When you are playing against the best poker players in the world, those wits can get pretty sharp.
Although luck in the drawing of the card matters, there is more to poker than that. Strategy, mathematics, psychology, handling pressure and several other factors go in to making a superior poker player. The ability to purposely lose is a very definitive argument that a game is all skill. If you were asked to purposely lose at roulette, craps or slots, you could not do it. This is because there are no decisions to be made in either of these games so you cannot purposely lose and so these games are 100% luck.
The state lottery is another demonstration of a game that needs no skill. It is never interesting to watch people stand in line in order to but lottery tickets, but the skill of the poker players has become legendary, and very interesting to watch on television. |
